H4-H1 Stamoing-Aug 27th Tijuana-Urgent!!!

Hi ,
My husband entered US on H4 while his H1B is being processed.So he need to go out of country for stamping as he received his approval notice I-797B without I-94 .We are planning for Mexico -the Tijuana Consulate for Aug 27th .But I have few questions:
1)Can we go in August for stamping ?As his status will be valid from ctober 1st will he have problem entering US ?
2)How is Tijuana for stamping ?
3)In his Approval notice, there are few corrections to his DOB and First name , Should this be fine at consulate?

--his DOB should be what is hiss DOB on his passport and his name should be what is on his passport. Ask the lawyer who filed H1 to get that corrected

Get the correction on H1 approval. check the copy of his H1 Papers that lawyer filed for his H1 (lawyer has the copy of each document that was filed with USCIS). many times it is lawyer mistake on the forms and not USCIS mistake. if it is lawyer mistake then let the lawyer pay the fee for correction.


* what is mistake with his name and DOB on approval notice???

Thanks for the reply .

The corrections are in his first name instead of 'E' they inserted 'A' and in DOB '6' in place of '9' and vice versa .

So you think it is not safe to go stamping before these corrections are done ?Or can we go when the Amendment is in progress ?

H4 to H1 COS pls help

Hi,
I applied for my H1 when i was in India and later got married and came to the US on H4. Now my H1 is approved and have received the approval notice (I797 B) without I94. My question is that :
1.Should i travel outside the US (preferably Canada) to get a new I94 or is there a possibility to request for an amendment COS now that i am already in US.
2.If so how long will it take for the change of status to be done
3. What are the possibilities of the COS getting rejected
4.And if rejected will i have to travel all the way to India or can i travel to Canada to get H1 stamped / get visa re-validated

you are on H4 status in US and you got I-94 at the time of entry to US that is based on H4.
now you have got H1 approval notice that does not have I-94 attached with approval. if you want to work on H1 status then you neeed to go out of US, get H1 visa stamp and then enter US on H1 status and you will get I-94 based on H1
