I am looking for some information on H4-H1 transfers.
I came to US on H4 in June 2001. I was here for 9 months. I was in India for 12 months after that. Then came back in March 2003. I am here since then except for a 3 month vacation in India in 2006.
So totally out of the 6 year H Visa I have spent 21 months outside of US.
My husbands GC process is going on and he has got his 3 year H1 extension based on his 140 approval. So my H4 also extended to 3 years.
I am in the lookout for H1 sponsors so that I can start working.
What I would like to know is whether I can recapture these 21 months for my new H1 ( If at all I am successful in finding a sponsor and a job)?
If so then my H1 papers will be filed only in April 2007 and I can eventually start working from Oct. 2007.
Also I would like to know how this recapturing done, whether from the last expiry date or from Oct 2007?
If anyone has any information on this please write to me. I highly appreciate the help.
