H4 for spouse

Hi, I am in I-485 stage of my Green card. I plan to go to India and get married in next few weeks. I was wondering if I can still sponsor an H4 for my spouse. My H1-B is still valid. Does filing for I-485 makes getting H4 difficult for the spouse? Any help would be greatly appreciated.

No Problem

You can get H4 based on your valid h1. Take letter from employer, your visa , H1 document, paystubs and apply with marriage certificate and other documents (see ttsvisas.com for document list) with the consulate.
H visa holders can immigrate to US and H4 need not prove that there is intention for non immigration.

Thanks Jaxen

Jaxen, Thank you very much.

Does it matter if the person getting H4 is a guy?

I went to the site you suggested. However, any link from Delhi Consulate shows junk characters on my browser. Not sure why.

When I filed for I-485, I got EAD as well. I did not use it anywhere and my H1 is valid for another year.

I was just confused that if filing for I-485 makes getting H4 difficult. My would be might have an option to get J-1 visa sponsored by a university here and I was not sure if he should try to get that stamped first. The positive side is that if he gets it, rejection of H4 would not be a problem. Negative side, if he is rejected, how it will affect his H4 application?. Not sure what approach should we follow.

Since we are not married yet, he has not filed for any immigration status. and hence he does not have AP. I also did not go for AP because I thought I can come back on H1.
