Hi,

I am in the US on an H4. I am already have an admit and also have the I-20.

Could someone please help me with the following queries?

1> Do I have to go to a consulate to get my F-1 or do I send my papers to the INS? I have been getting conflicting inputs on that.

2> I am sure the question about "intent to migrate" will surely arise. Any suggests on how to convince the authorities that I have no intention to migrate?

Any help will be greatly appreciated.

One more question guys....

I have an admit for a 2 year associate program in a community college. Is it difficult to convince the INS to get an F-1?

If yes...why? I am doing a program generally not available in my home country and since I am already here...wouldn't that make a difference?

you can go to school on H4 and even pay in-state tuition.
Hope it helps.

As for a status change: you can do either - change of status through USCIS or go home to get an F-1 visa.
 
in-state tuition not always

in some states H4 visa holders get to pay in-state tuition but not in all. in arizona the main university stipulates that you can only pay in-state tuition if your spouse's labor certification application has been approved over and above the fact that you have lived in the state for over a year. there are technicalities to that too and need to be checked with the particular university to which you are planning to apply.

Lucy, Phoenix, I know I can do my program on an H4. Bottomline is, I am not eligible for in-state tuition rates. So, my next best option was to get an F1 and pay atleast in part by getting an in-campus job.

Anyway, my other main concern was - since I am already in the country, do I just send my papers to USCIS, (in which case would I have to go through an interview etc.) or do I have to go a USCIS branch in my state anyway to submit my papers and be interviewed? I hope I am clear in what I am trying to say. That reads pretty confusing to me :D .

Also, what are the chances that an F1 would be rejected in my case due to the fact that I am enrolling in a community college? The program is not widely available in my home country, though. That I guess is a good reason for me to do the program. But the question arises....why F1?


What you guys have any ideas about that?

Yes. read the instructions on I-539 form very carefully.

No, it's all done on paper.

what school you are enrolling in is irrelevant. What is relevant is showing non-immigrant intent, money and inability to get a visa outside the US.
