H4 > F1; Now AP; Travel outside?

Hi,

I did my Change of status from H4 to F1 in 2006. Completed my MS in 2007 and I am currently working on my OPT-EAD.

My husband filed our AOS in early June this year. We got our EAD approval notices this week. Waiting for our APs approvals.

I wanted to travel to India in December this year.

Question:
1) After my change of status from H4>F1, I never went outside of US so my F1 visa is not stamped on the passport.
Do I need to stamp the F1 visa even if I would have my AP approved?

2) What travel documents are necessary to travel outside under these circumstances?

Any help and suggestion would greatly help me understand and better plan my trip.

Your F1 Visa need not be stamped in your passport. Since you are planning to use AP, you can pretty much forget about F1, as you are not using it to re-enter.

F1 is a single entry Visa, if you plan to return on F1, then you will need the stamp in the passport.

Carry your I20, approval of F1 visa etc with you. If you intend to re-enter US without the AP approval, then you will need F1 visa stamped in your passport, otherwise, not needed.

There's no way they'll let her enter on an F1 with a filed I-485. She needs AP, and should not leave the US until she has it.

Thanks. I have received my and my husbands APs.

I have another quick question:

is it possible to have me (secondary AOS applicant) do port of entry using my AP (485 receipt + all other docs) and my husband use his H1-B(7th through 10th year) valid till 2009 and stamped on his passport...please advise?


My husband wanted to continue working for his current employer and wanted to remain and maintain his H1-B status and not use EAD.
I wanted to use my AP status and use my AOS EAD (iam already working on using my OPT-EAD currently).

is there any problem using above 2 different mechanisms in the same family?

Please advise.
