I am sorry to start one more thread- but i just didnt know where to post this question:

My wife came to US on a H-4 visa in Feb 2000 (visa validity was from Feb 2000 – Feb 2003). In February of 2001, she got an F-1 status while studying for a Masters program. She had a valid F-1 status from February 2001 to April 2003 (including the 1 year practical training period). In April 2003 before the F-1 status ended, she applied and received an H-4 status from INS which is valid till October 2004. Can she apply for the visa revalidation at St. Louis ?

PS: If readers didnt follow the issue is - can she treat the original H4 visa as if it expired in Feb 2003 - or do you have to treat it as something that expired when she had the status change, which will put her beyond the 1 year limit for applying at St Lous.

Thanks

change of status makes her ineligible for revalidation within US. She could have pursued her studies in H4.

Hi Jaxen

Hi Jaxen,

Thanks for your reply. I got a reply from Mr. Khanna regarding this saying its fine to apply for revalidation - since she has a H4 stamping in her passport.

Are you sure about your answer ? Could you PLEASE check and confirm this for me ? I would really appreciate it.

thanks
