My h1 and wife's h4 visa is valid till october 2004 . My company is applying for my h1 extension which will be valid till dec 2005. I am not sure whether my company will apply for my wife's h4 extension. Can you please provide me what option I have for h4 extension. Is it possible to apply for her h4 extension on my own after getting my h1 receipt(not the approval) ? I understand that if I apply for her h4 extension by my own then I have to fill the form I539. My h1 and wife's h4 visa is valid till October 2004 . My company is applying for my h1 extension, which will be valid till dec 2005. I am not sure whether my company will apply for my wife's h4 extension.
----- when your company is applying your H1 extension you Must apply for your spouse H4 extension with your H1, she needs to fill up Form I-539, if lawyer is sending your h1 extension request him that your spouse H4 extension should be filed with your H1 extension papers and in same envelope to USCIS. You and your wife will get H1 and H4 extension on same date and your I-94 that will come with approval notices will expire on same dates and you will have no confusion or forget to extend your wife H4 in future. Ask they employer/lawyer that you are going to pay the fees for your spouse H4 extension (employer is generally supposed to pay only H1 extension fees and for spouse H4 extension you have to pay the fees or employer can pay for H4 extension and can deduct from your pay check.

Thank you very very much ginnu. But looking at the form I-539 , there is a category where in it ask to provide if the h1 is pending information. Is it okey if I apply for h4 extension , after my husband get the receipt of h1 extension ( not h1 approval) . Please guide me. thanks again.
