H4 extension - Jaxen/Ginnu/Vortex please reply

I am working for employer A on H1B visa. I have already filed for H1B transfer and will join employer B on 06/01/2004 after I receive the new notice of approval ( H1 transfer filed in premium processing).


I understand that H4 extension is only to update I94.

Can my wife leave USA and enter back on new H1B visa approval? That way the new I94 issued to her at port of entry will reflect the new H1B visa?

My wife was planning a trip to canada by road. So at the border
she can surrender the I94 and on coming back she can get a new I94 based on the new H1B approval. ( She does have a H4 visa stamped on her passport valid until end of 2005).

I want to make sure that I do not jeopardize her visa status?

Please advise.

Assuming that the current I-94 is reflecting 12/2005 as the validity date, you need not go though this process.

But if you want to, I think the Canada/Mexico trip should work.

So, I do not need to apply for H4 extension? Which is basically filling up for I529.

Please let me know if I need to apply for H4 extension separately?

I'm assuming your spouse's I94 is valid till end of 2005 (as is the visa).

Normally changing companies does not require to get a new H4. So I believe same would apply here.

As far as here I94 is valid, she is in status.
