My H1-b and my wife's h4 visa expire march 31.
--- your copany CAN file your H1 extension 6 months advance of your I-94 expiry date and your wife H4 can also be filed with form I-539 with your H1 extension
My company is in the process of filing for extension of our h1-b and h4 but approval won't be in before last week of March.
------ if your H1 extension is filed BEFORE your I-94 gets expired then you are in status
My wife is going to be traveling and will be entering US around March 20th (10days b4 visa expiration). Will there be problem at the point of entry - technically i know there shouldn't be - but in practice ?
------no ( if she gets H4 extension filing reciept before she departs US then better keep that H4 extension filing reciept with her and show ONLY if asked at POE, generaly they dont ask)
*** if her H4 extension gets approved while she is out of US then the I-94 that she will get at POE will be latest I-94 based on the validity of H4 visa stamp
*** if she is reaching US with valid Visa and her H4 extension is approved AFTER she reaches US then the attached I-94 with H4 approval will be last action
Anybody had any such experience?
