H4 Expiring on August 28 2004 - I-20/H1B ?

My H4 is expiring in Aug. 2004.
1) Applied for admission into Graduate School
for fall 2004 and waiting for I-20.
2) Can I apply for H1B under 2005 quota that
starts in October. If I apply for H1B before
Aug.2004 (expiration of my H4). Will I be in
legal status starting from Septembet till my
H1B is approved.

------ you need to file Change of status from H4 to H1B, once it gets approved and you get I-94 attached with H1B approval you will be in status, you canot start working till your COS is approved.
