My company missed filing for my wife's H-4 visa extension when they were filing for my H-1 extension. I came to know about this 3 days back when trying to get appointment for her drivers license. She has been out of status for 5 months and 14 days now. I looked up for options available for us at this time and it seems the only and best option available now is for her to leave the country and get her H-4 visa stamped. I know I have to get her visa stamped asap and more importantly have her out of the country before her 180 days out of status. I would appreciate any information from anyone who had similar situation and their experience. I am planning to leave the country with her so we can get the visa stamped together. Has anyone with similar experience (H4 visa expired) tried or considered visa stamping in Mexico and if so I would appreciate their advice. Thanks

----------------Best Option Let her go out of US ASAP and get H4 visa stamp from US consulate.
I know I have to get her visa stamped asap and more importantly have her out of the country before her 180 days out of status.
---Correct. she should be out of US Before she hit 180 days of out of status. She should make the Copy of her I-94(front and back) for future records and ask her to keep her Boarding pass for future to shoe that she departed US on date....
I would appreciate any information from anyone who had similar situation and their experience. I am planning to leave the country with her so we can get the visa stamped together. ----- As she is out of status she may NOT get Visa stamped in Canada/Mexico

Thanks Ginnu. We have decided to go to India before her 180 days and get our visa stamped. Any suggestions on filing out form DS 160 - the part which asks if you overstayed in US. I would appreciate if someone can share any experience on this if they said yes or no. If yes, then do we need to prepare any documents in addition to the explanation. Thanks in advance

regarding Visa stamping and form DS 160 info you must talk to your company lawyer.
