My wife only has an Expired H4 stamp on her passport. She has a valid H4 till 2004 may. We are filing our 485 (AOS), EAD, AP in october 2003.

1)Can she go to india after getting AP but before getting EAD?
2)We would like to avoid going to consulate in india for H4 stamping. So does she have to wait till I send her the approved EAD (whenever it comes) before she can re-enter US?
3)Do they allow entering US with a valid H4 document which is not stamped in the passport?
4)Any recent feedbacks on how long it takes for an H4 stamp from Chennai consulate?
5)Does she need to be in US while her EAD is approved, or can she leave before that, immdtely after getting her AP?
6)She might be in india for 2 or 3 months. If we get a fingerprinting appointment at that time, is it possible to reschedule it by more than a month?

thanks a bunch

--- YES

----She needs Approved AP in hand before departure from US. She can enter with AP or can get H4 stamped in India
3)Do they allow entering US with a valid H4 document which is not stamped in the passport?
---No, She needs H4 Visa stamp in passport
4)Any recent feedbacks on how long it takes for an H4 stamp from Chennai consulate?
---- read the other threads

EAD is only for work NOT for entry to US for entry she needs AP

---- YES, Lawyer should write a letter for reschedule

thanks ginnu for your informative reply. makes life very easy for a newbie like me.

i have similar questions for my H1 as well. I have only expired H1 stamps on my passport and my current H1 expires end of Feb.

1) If I am travelling with her (after getting the AP) (say in Dec-Jan), in order to re-enter US, do I need an approved EAD? Or can I show any other docuements to re-enter (like an EAD receipt or something, if it exists).

2) If the above doesnt work out, will I be forced to stamp H1 on my passport from the consulate? (I dont have the luxury of time).

3) My guess is that for MY travel, I would require an approved EAD (because I need something to work here), whereas for my wife's travel I dont need an approved EAD. Right?

4) Even if I do decide to get the stamp on my H1, will there be issues at port of entry because it is only valid for a month or two?

thanks once again for your time.

----------- you have to show AP and passport, approved EAD is not needed EAD is for work not for entry to US, if your consulate is not Chennai then you can also get H1Visa stamped you may get PP back in 3-4 days
2) If the above doesnt work out, will I be forced to stamp H1 on my passport from the consulate? (I dont have the luxury of time).

------------No problem you can enter 3-4 day before of H1 visa stamp expiry date, you have applied I-485 so your status after I-94 expires will be AOS pending
