Hello,
My wife is on h4 and we are thinking of ways to get her work permit. One thought is to apply for canadian permanent residency and later for TN visa. Can she join my green card process when i file for 485 ? Are they any repercussions that would hinder the green card process.
The idea is to get her to work at the earliest while we wait till the green card goes through which might take forever given my nationality :(

Thanks for your help!

TN visa is only for Canadian Citizens not for permanent residents. It would take your wife 4 years or more to get the Canadian Citizenship after acquiring the permanent residence and legally she has to be in Canada for atleast 3 years inorder to be even eligible for applying for the citizenship. Your best bet would be to wait for EAD which you could get three months after applying for I-485 and then your wife could work w/o any problem until your GC process concludes. As far as I know, your wife's information should be included in your I-485 inorder for her to get her GC along with you hence the EAD would work for both of you in the same way.

No, she needs to file an I-485, ideally at the same time as her husband.

Thanks for the reply. Is the three months period for EAD always the same or is it the minimum duration? In the event she converts to F1 and joins the I-485 process, does she have to give up F1 status and get back on H4 ? Is there a place I can get information of various such scenarios ?

Thanks again!
