URGENT!!: H1B1 visa extension and federal labor clearance – please help

Hi All

My employer doesn’t know any thing about immigration. My Green card process is going on. Its on federal labor clearance. And my visa going to be expire on 22 Feb 2003. And my employer thinking that I don’t need any visa extension. But I know I need visa extension. My questions are ,

1. Do I need H1b1 visa extension while my federal labor clearance going on ?

2. What’s the process for H1b1 visa extension?

3. Do it need new LCA for H1b1 visa extension? ? I think LCA also has expire date.

Please reply my questions , I need it

Is Feb 22, 2003 the date of expiration for the visa stamp on your passport? If so, when does your I-94 card expire? You would need another H1B petition only if your previous approval (I-797) and I-94 are expiring. VIsa stamp is required only for entering the US.

Yes you would need to maintain your H1 status while the labor stage of your green card is under processing.
