This is in reference to the H1B petition filed on behalf of one of the prospective employee
for whom receipt was never received.
We filed for the H1B1 petition in may end of this year and never received the receipt.
As you know the USCIS customer service is not same as it was earlier, when we called them in
June they asked us to wait for 30 days.
After 40 days of maining the initial petition we sent a letter to inquire on the same but
haven't heard back.
We later filed for the premium processing with the required form/fee and copy of initial
petition which was received by USCIS on Aug 11th (got this info by tracking the package).
When we didn't receive the email update from premium processing we called premium processing
service and they again mentioned to wait for 30 days for receipt while PREMIUM case has to
be turned around in 15 days.
Same time we initiated email correspondance with VT premium processing center via email and
after exchanging couple of emails we were told their is no case in thier records, It is
possible that the file is subject to the FY2006 cap and may be rejected.
What you guys suggest in such a scenario, how can we follow USCIS on this petition further.
Our company really need this guy in USA, is there any other way we can bring him.
