H1B1- no W2

Hi All ,
One of my frd. came to US on H1B, and on bench since 11 months(no pay stubs so far, except one in Nov 2004). what I am suggesting him is go bak to India for good, and search job there, as it will be very tough for him to get green card and its illegal to stay in US with out any job, right.
In this regard, I want your advices to take a better decision.

Already he is out of stauts. Even he gets any other job in USA, he can not transfer his H1.

Better go back to India, try new job and come with fresh H1.

Other alternative, join School with F1 visa.

Got couple of questions
1) Current H1B1 is valid till 2007 Jan.
2) Will that be possible to get new H1B? (not transfer)
3) And go Canada / Mexico, for stamping for new H1B
Idea is to avoid situation *out of status*.

H1 transfer will be definately denied. You can not apply new H1 while you are in side H1 without referencing your older h status.

Canada/Mexico always risky for your case, if it got rejected you have to go to your home country directly.


Idea is to avoid situation *out of status*.

H1B1----> F1

For converting H1 to F1, is that allowed to attend consulates in Canada / Mexico for stamping or should to back India?
