Iam in kind of confused situation. I got laid off last year from a
big company. I got a new H1 from a new employer after 4 months
but I did not take up work. Iam offered LCA substitute from a
different employer for Green Card. Iam running the risk of running out of my H1b 6 yr cap. I could not take up work in between because of ill health. Will I be having lot of problems with INS ?
 
Yes. Possible. You need to prove that you have an employment and valid status now even if you dont work for the sponsoring employer. While on H1 you are supposed to be working for the employer and get the salary promised in LCA/I129
