H1B: years of experiance under TN

Hi,
I've been a total of 12 years on a TN (systems analyst).

Company A 4 years
Company B 8 years (current)

My current employer (B) is going to apply for an H1B visa for me, but it was stated (by a lawyer) to me that I can only use my 4 years experience from previous employer (A) and cannot use my 8 years experience in the current company (B) .
So my experience will be based on 4 years and not 12 that I have combined, basically wiping out my recent 8 years of valid work experience.
Is this correct?

--------------- Lawyer is correct if B is filing H1. if C or D is filing then they can use 12 Years EXP.
