H1B withdrawal

Hi,

I have a H4 visa and I-94 valid till July 2008. I have applied for a H1B visa (start date of Oct 1st) that is still pending. However, I do not want to take up the job and want to remain on H4 status. What is the best way to do this? If the employers withdraws the pending application, how long will VSC take to do this? What happens if this after October 1st? Any help or similar situations, please help.

-------------- only employer can withdraw the pending petition of COS from H4 to H1 as H1 is filed by employer

Please tell me what the procedure is. Or can we go out of the country and enter under H4 again when it is pending to keep the H4 status?

---------- if you have valid visa stamp then go out of US and enter on H4 status you will get I-94 based on H4 status
