H1B with out I-94 Card

My Optional Practical Training(OPT) expired on June 30th, 2004. My H1 has been approved on June 30th but I did not get the I-94 card with the approval notice. My lawyer told me to leave the country, get the visa stamping and come back with in 10 days befor Oct 1st.

With reference to the bulletin posted in Murthy.com on July 23rd which says students can stay in the United States even after 60 day grace period without leaving the country. My question is can I refile for I-94 and stay in the country or do I still need to leave the country and get the stamping and come back.
