H1b - wait in US or back to my country?

Hi Everybody.

If anybody can help me? I got proposition to work as coach for governent's school. School asked me to come to US and wait for H1b visa and practice english. I recived receipt number from Texas INS at September 3, 2002. They wrote it'll take 90 - 120 days to give me H1B. 120 days already has gone and nothing! My turistic visa will expier February 3, 2003. What should i do? Should i come back to my country now? Is it true i can recive H1b only in emmbasy in my coutry? If i come back to my country should i inform INS I changed adres and I waiting now for visa in my country and how to do it. How are they gonna inform me about visa if i change adres from US on my coutry? Most important - how long it can take to recive H1b?

I'll be grateful for any news.

You can wait in US for H approval. You can start working only after receiving H1 approval. Until INS comes back to you with a decision on the B to H petition, your status is safe.
If you go back to your country, you will abandon the B to H visa change of status.
You can work with the school without a H visa in passport. But when you leave US next time, you can continue your job after coming back only with a H1 visa from a US consulate.

First - thanx for reply! Are you sure i can stay? I called INS and they told me i have to leave USA if i don't have extension of Visa B! They told me also I can recive my H1B in my country and they will inform me by emmbasy. I realy don't know what to do! My b visa will expire 3rd of february...
 
Was your H-1 filed as a change of status from B-1/B-2 or as a new H-1 for issuance at the consulate?

The answer to your questions is entirely dependant on the answer to the question above.
