Suppose I have an H1B Visa from CompanyA. I stamp H1B visa on my passport and entered US. Now I dont want to join CompanyA.
I have a job offer from CompanyB and want to join CompanyB.

Is this possible. Do I have to transfer the H1B or get a new H1B.

Has any one been is such a situation. Please let me know how it was resolved.

Regards,

Ronak

If you want to join CompanyB, you may need to get a new H1B approval notice on behalf of CompanyB. Consult with the attorney of CompanyB regarding the paperwork.

AND if you apply Fresh NEW H1 then no I-94 will be attached with H1 approval notice and you may be subject to CAP for NEW H1 (H1 cap may reach any time) and have to go out of US get new H1 visa and then enter and work with B. be ready for many questions from US consulates for H1 stamp they will doubt if the new employer has job or why you did not work with A. you have to explain all and have to convince visa officer, many are facing problems for H1 visa stamps in US consulates in India

Thanks ginnu and sselva69 for your responses.

My Lawyer says that there would not be any problem to transfer
from CompanyA to CompanyB. I even questioned him about
the pay stub requirement. He says that it is not necessary.

I need to be very sure as to what would be the result.

Has anyone faced a similar situation or has more information
on this please respond.

Your lawyer or liar is giving you wrong info he just needs the fees. You need pay stubs for H1 to H1 transfer. Go to other good lawyer
