H1B Visa - Transfer

Hello All,

Please help me out with a query...

My H1B has just been filed for transfer (Not yet received the Receipt against my H1B Transfer Petition), so can i legally work for my new employer, or do i have to wait, till i receive the receipt from USCIS.

You can start working after filing by showing your I-94 from earlier employer. From USCIS:

"H-1B employees changing employers (porting)
Under the American Competitiveness Act in the Twenty-First Century (AC-21), an H-1B employee who is changing employers within the H-1B program may begin working for you as soon as you file a Form I-129 petition on his or her behalf. To qualify for AC-21 benefits, the new petition must not be frivolous and must have been filed prior to the expiration of the individual’s period of authorized stay. You must complete a new Form I-9 for this newly hired employee. An H-1B employee’s Form I-94/I-94A issued for employment with the previous employer, along with his or her foreign passport, would qualify as a List A document.

H1B visa transfer though I never traveled to US

Hi Sir

I have a valid H1B visa right now but I didn't get an opportunity in my current organization (Company A) to travel to US
So I am planning to apply for a job in some other organization (Company B) in US.

For this I have the following 2 options:

1. Is it possible to transfer my H1B even though I never traveled to US with this Visa.
2. How easy it is for a the company B to transfer my visa and what would be the procedure.

I am looking forward to work in US and wanted to find out how can I use my current H1 visa.
