H1b visa transfer information

Hi,

My query is regarding my H1b transfer.

Have worked for company A for the last 8 years, and hold a valid petition from them. The H1b visa has been stamped on my passport too. Am in Indian right now, my query is as follows,


1. Is H1b transfer from A to B possible when in India, and how long will it take if its processed in premium mode in India itself?
2. Once company B files for the transfer and its been approved, can I travel into US on this basis…or do I need to wait to receive the Hard copies of the petition for traveling.
3. Instead of putting my papers down in Company A, can company B process my H1b transfer until I receive an approval about the transfer. Or do I need to put down my papers first in company A and join B……and then apply for H1b transfer.
4. Will there be any implication on my visa if company A cancels my H1b.

Hi,
My issue is more or less on the same lines..
My H1 was approved in 2004 quota through company A and was in US from may2004 to may 2005.My visa got expired in may2005 and i came back to india in may2005 and left company A and join company B.
Now a company C says that since i was on H1 uptill May 2005, i am cap exempt so no need to wait for 2008 quota even if my H1 is expired and i am in india for last 2 yrs and they can file my premium H1 transfer .
So my question is how right they are?
