H1B Visa to EAD Card

Hello Everyone,

I am on H1B. My husband apply for (I-140 and 485) non-concurrent. I got my EAD card. I have some questions:

- My company offers me Full time position. As I know that if I use EAD my H1B Visa will be gone. So I want to know that what will be my status if I use EAD?

- I am working on H1B, can I use EAD right away. or is there any documentation work invlove when you switch from H1B to EAD?

I am very confuse in using my EAD card. Any help will be really appreciating

If you use your EAD, you will become what is known as an "adjustee", i.e. Adjustment of Status pending. If you intend to remain at your job, and you have an H-1B with them, it may be better not to use EAD for now unless you want to work at a second job somewhere else.

The only documentation is that you go to your human resource manager and update your I-9 form. Under employment eligibility, you update your form to say that you are working by virtue of your EAD, not H-1B visa.

But it sounds like you don't need to do anything. If you're happy where you are, just stay with your H-1B for now. Put the EAD in a drawer somewhere and forget about it!

one disadvantage for not using EAD in stable job is that you exhusting the 6 year maximum allowed for the H. If anything wrong happen with the pending I-485 then you will be almost exhausting all your 6 years and you have to leave. My thinking is: If you have stable job, just use the EAD, it is very simple piece of document to work with and renew it in advance (4-5 months) and the rest of the years remaining from the H will be saved for you in case you may need them.

I am on separate H1B, My husband is also on H1B visa and he applied for our green card. Only I applied for EAD, but my husband is still on H1B, we know that it is safe. My question is:

- I am on separate H1B, my company offers me full time only if I have EAD. so If I use EAD, my H1B will be gone. I want to know that if I use EAD, will it affect our green card process?
