My H1B Visa stamp is annotated at the bottm:

PARTY IS NOT INTENDING IMMIGRANT, MEET RULES

In the visa application I had answered "yes" on the question if someone has file immigration petition for me. This is because I had an approved I-140 at the time I applied for the visa stamp at the US conulate.

My question is what does the annotation on the visa stamp mean, and would it cause any problems.

Thanks for your replies guys and gals

What US consulate did you apply?
What did the consular ask you?
How long ago was this?

Guju,

That was in the US Embassy in Cairo, Egypt.

The H1B petition was approved in February 2000. The visa was Stampped in the passport in October 2000.

I applied for I-140 in May 2000 and approved in Septmeber 2000.

So the H1B petition was approved before applying for the I-140; however, the stamping was after the I-140 approval.

I attached a note to my H1B application to the Emabassy explaining that I had an approved I-140. This initiated an interview at the consulate. At the interview I explained the situation to the consular, she checked with her supervisor, and he said to her that he just wanted to maintain status, so approve the visa. That was it.

The visa has expired already. I did not notice this annotation until a couple of days, and was wondering and worreid if this annotation would have any adverse impact on my AOS.

Thanks for any advice, the worry is killing me. I feel sick.

well since you got your VISA stampped and re-entered, did you get EAD, AP or FP notice?

If you got any of those, then seems like your 485 is being processed and is not abandoned.

To be on the safe side, why don't you ask your lawyer what it means.

Also I hope some senior members like Jaxen would shed some lite on this subject.
