H1B Visa Revalidation at New Delhi Consulate(Urgent !!)

Hi All,

I am scheduled to appear at New Delhi Consulate on 4th January to get my H1B Visa Revalidated. I am in 6th year of my H1 and my Green Card process is at the Labor stage stuck at PBEC.

My original I797 was misplaced by the lawyer and he had to file another I-129 to get a duplicate. I have heard of a few cases where people have been stalled citing administrative purposes.

I have been with the same company for last 3.5 years and already have a H1B stamped from them. Its a manufacturing company and I am a permanent employee with the company. I have a 3 yrs Diploma + 1 yr Computer education which was evaluated as an equivalent to BS in Comp Sci. by Trustforte in 2000.

I am concerned about my H1B revalidation. I have 7+ yrs of experience in IT including 5+ in US itself. I will be carrying all the necessary paperwork including my tax returns and recent pay stubs. I will also be taking a letter from HR dept of my company stating my location, title, duration of employment and salary.

I am currently pursuing studies in US with expected graduation in May 2006. In addition I have liabilities like car, apt lease etc. My wife is on H1B as well.

Should I be worried about getting stalled in New Delhi?

Any advice will be highly appreciated.

same situation as me

It appears you are in a similar situation as I am and I am still in a dilemma if I should go ahead and travel outside of USA. I am in my 7th year H1 and appearing for interview at New Delhi on Jan 03 for my H1 visa revalidation (although I belong to Chennai region). My GC process is also stuck at LC stage at DBEC. I am also worried about getting stuck in India due to security clearance. I am constantly worried nowadays thinking continuously whether I should go ahead and embark upon India trip (although it's important for me to visit India). Sometimes, I think I shouldn't face any problem getting my visa revalidated while the very next moment, I feel what if I am stuck? It's now a million dollar question to which I don't seem to find answer.

Nobody knows the answer ???

Hi GCOnly,

seems like nobody knows the answer.

I asked my lawyer to tell me about it. He replied by saying that I cannot come back unless I get the visa.

He said ideally I should not have any problem if I have all the paperwork but he also said that he cannot do anything if I am stuck since this is a Govt. Matter.

It seems like one is stuck between a rock and a hard place.
