H1b Visa Revalidation as first 3 yrs coming to an end.

Hello,

My first 3 years of H1-B Visa is getting expired in August-2006. I came to USA in November-2003 after I got my stamping in Mumbai in September-2003.

I've following questions:

1) Can I go to any US Consulate in Canada for my revalidation? Any issues or things I need to take care of?

2) My green-Card is in process (awaiting Labour Clearance) through PERM. Does GC application has anything to do with revalidation in the sense that it may put H1B revalidation in jeopardy when I go outside US?

3) Irrespective of where I go for revalidation(Canada or Mumbai), can I get it done in Dec-2005? Is it a rule that I can go for H1-B revalidation only before 2 months of my first 3 years coming to close?

4) I am going to India in Dec-2005 and want to bring my to-be wife on H4. I thought my to-be wife better applies for her H4 after I get my revalidation extension. Or else again after few months we both would be required to apply for revalidation again. So, I am thinking of getting married in June-2006 because of this issue. Hence the question no.3

First apply H1 renewal and get it approved and have an original H1 approval papers with you, before going for revalidation.

If the old one is not expired, go 2 weeks before expiry or after expiry. If you are going to do it in India take interview appointment. You may not get it whenever you want it

Better go along with your spouse for revalidation. But appointment needed for your wife too.

Ofcourse, I will apply H1 renewal and get it approved. My question is: for such revalidation, is it ok to go to Canada?

You can go for revlidation as soon as you get your H1 renewal / extension approval. If the old one is not expired, go 2 weeks before expiry or after expiry. If you are going to do it in India take interview appointment. You may not get it whenever you want it
i.e Will take an appointment for revalidation extension in India(Mumbai). From your answer, I gather that I can apply for H1 renewal and get it approved only before 2 weeks or after 2 weeks of my 3 yr expiration and not before that. And that implies I cannot go for my H1 extension in Dec-2005 as mine expires in Aug-2006.

Will take appointment for wife too. From this answer I gather that I should apply for wife's H4 after I get my revalidation extension OR apply her H4 along with my H1 extensionon the same date or after that.....

Please let me know whether I interpreted your answers correctly on all the points.
