H1B Visa Re-Stamping Help

Answers below:
1. Only the visa application fee of $100.00 (as of May 2007) is necessary for Indian nationals (no visa reciprocity fee).
2. Yes the revalidation by Department of State was discontinued after 2004.
3. Once you get the re-stamping you are free to travel till the visa expiry date.
4. Yes you can re-validate on or after September 2008. Why do need to re-validate the visa so early? If you travel around that time, you can use the existing visa to return.
5. Employer is not going to stamp the visa, however, you need an employment letter the confirms your employment.
6. I carried the following:
  • Pay-stubs,
  • W2,
  • Educational Credentials,
  • I-797s,
  • Employment letter,
  • Bank Statements.
7. Take a few recent ones.
8. You have a good chance as long as you maintained status and your employer is non-fraudulent (as viewed by visa officer).
 
4. Unless things have changed, I was told I could re-stamp only 2 months prior to my current visa's exiration date. Or any day after. So for you that would mean you would not be allowed to re-stamp a new visa before July 30. I read somewhere that they were given a 3 month window. Please contact the consulate you intend to visit (perhaps by email) and see if they have any such policy.

Early Re-stamping

Mine and My wife visa is getting expired by July 2nd,2008. We had a baby month before in India, right now I am in US and processing my
H1B Renewal I will get approval for next 3 years by May'08. My question is when she goes for my child visa appointment after my paper approval can she get stamped for her passport for next 3 years? She is planning to come US by June'08.

How can I revalidate my H1-B expired 355 days ago?

Hi Immigration Helpers,

Here's my bulleted list of information about my expired H1-B, which I would like to revalidate or re-stamp.

My first question: Do I still have some chance to get my visa revalidated with expiry time = 355 days?

1) My only H1-B was issued on Oct 20, 2004 and expired on Mar 27, 2007.
2) I stayed in USA only once with that H1-B from Aug 2005 to Jan 2006.
3) Now I am in Canada on student visa and still have 10 days to apply for H1-B re-stamping. Can I apply from Canada?
4) Previous sponsor was an IT company.
5) No new sponsor currently available but which type of company should it be so that I can get re-stamping done easily?
6) My last paystub is for Jan 2006. Can I use my paystubs?
7) What documents do I need from my previous sponsor - a) ones that I used for H1-B application and b) ones that I would have to request anew?
8) What documents do I need from my new sponsor?
9) How much will I have to pay for the application?

I will highly appreciate your valuable comments and guidance.
