Hello Immigration Expert,

I came to US on a student visa and completed my Masters in Dec 2007. My OPT started in Feb 2008 and was valid till Feb 2009. A company A offered me a job and applied for H1B in 2008 and got approved meanwhile I started working for them in July 2008 till Dec 2008 and now I do not have a project. My Employer want to terminate my H1. I would like to know:

1. What is the grace period for me to file for a transfer after the termination is sent to USCIS?

2. Can I file for Transfer of H1 to another employer after termination of H1?

Please advise on what I should do? Your advise will be greatly appreciated and thank you in advance.

--------------------- H1Transfer by new employer should be filed before your employer revoke your H1 by writing to USCIS.

2. Can I file for Transfer of H1 to another employer after termination of H1?

If you have other US employer let him file H1 transfer for you BEFORE the past employer revoke H1 by writing to USCIS and start working once get H1 transfer filing reciept from USCIS or any evidence that USCIS got H1 transfer petition.

Thanks for replying, I ned to know if I do not find and Employer to file for my H1 transfer do I have any grace period after the termination of my H1B?

Your grace period is 10 days after the termination date is lodged with the USCIS so any delay to that will increase the time you have to find a new role.
