h1b visa out of status

I have been laid off from an american firm , where i was working as a permanent employee.

Now how much time do i have before i can file for a new H1 B with a new employer. Is it possible to file for a new H1 after 2 months , or will it be rejected since INS has already been informed about my H1 status.

please help..
 
When you are applying for new h1, you need some recent paystubs. There is no standard for acceptance of old paystubs by BCIS. Pre 911 they even allowed near to 180 days old paystubs.

By law you have about 10 days from the last paid day (count severance pay )
It depends on the service center too.
