Hi,

I came to US in 1997 on F1 with a visa stamp. Graduated and worked on OPT for a year and then transfered my Visa to H1 for company A in 2000. I got my stamping in canada in 2001. My company closed in dec 2001 and I got another job in company B in 2002 and got my approval notice with I 94 and I797. Meanwhile my passport was due to expire in 2003 and hence I renewed my passport in Indian consulate in SF. THey have cancelled my old passport which has the H1B stamping for company A on it.

I have not yet got the stamping done for company B on my old or new passport. I will be joining my client company C on their H1.

THe question I have is.

1) Is my h1B visa stamping good enough for travel even after I transfer to company C? Can I use the approval notice with Visa??

2) since my old PP is expired and the stamping is on it, is that an issue???

I am thinkign the best solution is to go to India after approval to get a stamping or sent to St louis... however if I have to go suddenly to India.... will it be ok to still come on Company A's visa that is still valid till 2004.

Thank you

1. If the old visa stamp has not expired (datewise) then you can travel with I797 approval. Otherwise when coming back into US you need visa stamp in passport (any), preferably the latest visa

2. No
