H1B Visa: Mexico/ Canada

Has anyone recently, say in the past 2 weeks, gone to Canada or Mexico to get their H1B Visa stamping?

Hi sd1975,
Did you changed from F1 to H1 or H1 to H1. I will appreciate if you let me know about your Degree too. What i mean is, do you have a US degree or international degree.

I don't have a US degree. However I was extending my H1 visa. So they didn't ask me about my degree. I've met another guy he was changing his status from F1 to H1. He had a US degree and he's got his visa too.

In July months I thought of going to Vancouver for my H1 ext. But some one told me that they won't issue the visa, if you have International Degree and the US POE guys won't allow you, even if you have a valid I-94. So, I dropped that option. My H1 got expired on July 31st, 2003 and I have an approval up to 2005. I will try to attend the interview on Sep. Thanks again for your suggestion. Please let me know, is there any special instruction, I need to know.

In my case they just asked me to show the approval letter from INS, the last paycheck, and the employment letter. But I had prepared all the supplement documents for I129 petition including my diploma evaluation. It looks like they are not intended to give everybody a hard time without any reasons. If your case is simple and clear, you want your visa for the same employer as your previous visa then there is no reason for them to refuse you.
Anyway I was safe even in the case of refusal since I had a backup way to return (advanced parole). I don't think I would go there without this backup (I'm too paranoid in this matter lately).

So what's the problem? You have nothing to worry about! I don't understand your concerns.
 
Recently i got married and we applied for my wife's H4 visa. That is still in Chennai Consulate (India). I don't want to use my AP/EAD, before adding spouse to my GC Process. Hope you got it.

Well I got my undergrad from the US and I have always been in status. From what I got when I read the US consulate's website in Canada, as long as I have a degree which does not require the consultant to verify (since in my case its not international, its a us degree), and as long as one is in status, it should be good. What are you thoughts on my case?

My main concern is, although a citizen of India, but my F1 was issue in Qatar and I have also lived in Qatar for few years. I don't know if this can cuase an issue. Your thoughts or anyone who can share his/her experience?

Since background checks are nowadays being performed for some cases, I was thinking of requesting a FBI clearance. But I don't know if I present the certificate issued by the FBI (clearance) to the consular officier, and incase they were planning on doing a BG check, will the certificate help?

Would love to get some feedback from anyone!

I got you. I had the same situation. However my case was worse since I've used my AP. Now I'm on H1b once again waiting for my wife to join me.
Once again you will have to use AP only in the worst case. But it looks like your situation is clear and there are no reasons to refuse you. Even if you have to return with AP that doesn't mean that you can't add your wife to your I485. It only means that you have to get your visa in your home country and come back with your wife on H1 and H4. But once again it is the worst case scenario. So you don't have much to loose.
Why wouldn't you just wait your wife to join you and then travel?

It doesn't matter where your previous visa was issued. But it does matters that you lived in Qatar since you have to mention it in the supplement form DS157. It may raise some security issues. I'm not sure how they deal with this in the On-The-Border consulates as well as I'm not sure that FBI clearance can help you.
I would better try with St. Luis first. At least you are not leaving the country and you don't have to mess up your status by using old F1 to come back. It's gonna take much longer but it is the safest way.
