H1B Visa from F1 in profit organization: rules and restrictions without OPT

Hi,

I am on F1 visa and cannot get OPT, as I hasn't finished the degree. One profit organization is wiling to offer me H1b, as I have met visa screening and license requirements. I want to know, if I can join them or not.

I heard that a company can only apply after April 1 and then even after approval one cannot join before 1Oct. I expressed my concerns to the human resource department of hiring company, but they says that they can apply any time of year and I can join immediately after the approval. I know that is possible only in Non-profit organization.

If I want to join them in march 2011, can the profit company apply for h1b in Jan for me. I am not sure that human resource knows everything. What is the deadline for the profit company to file H1b? if the H1b positions are still vacant for the year 2010, can profit company apply for H1b in Jan 2011 under the H1b slot of 2010? I have job offer from one nonprofit organization also, but the offer from profit one is much better. So, I really need to know if I can join the profit organization in feb-march 2011.

I will really appreciate the help in this.

There is a cap on the number of these visas but the cap has not been reached.
