H1B visa extension along with H4

Hi,

Right now i am working on H1b visa which will expire January 2005. My employer is extending my visa H1B this month. I am getting married on November 2004.

Here are my questions:
1) can i attend consular interview along with my wife?

2) if any rejections, will my h1b visa valid till January 2005 or they cancel the valid visa? How many days before i have to enter US before expiration of visa. Is there any time restrictions or any questions in port of entry? I heard that we have to enter US prior 60 days before expiration of visa.

3) i came to US on June 2001 and left India august 2001 because my employer didn't find project for me. I don't have w2 for 2001. Again i came back to US in January 2002 and since then i have been working and i have w2 for all subsequent years. WIll they ask w2 for 2001 also because i stayed for 2 months?

4) can i attend Delhi, mumbai consulate as chennai consulate will be heavy crowded during November time frame. what are the reasons we have to explain on this regard to consulate officer in Delhi or mumbai? what are the documents needed from my employer if i want to attend Delhi consulate?

1. Yes
2. You can travel upto the day before expiry.Since an extension is pending this willnot be a problem.
3. Most likely not. You can give an appropriate explanation as to your going back to india. Maybe a letter from employer about how a project did not materialize in 2001 etc...
4. You can. Cite reasons for going back to work. Get a letter from employer that urges you to finish the ceremony and visa obligations as early as possible in order to attend to the emergency here:)
 
Need your help on information

Hi, may I have help from you on my question. Do you need to pay that $1000 again, i.e. the fee to train American workers that you paid when you first applied your H1b?
