H1B visa current(research) to H1B Oct-2007 start date

Hi,

I am currently on H1B visa with University, due to funding issues i may not able to stay on job beyond april-2007 at the most. Another commerical company is willing to apply for my new H1B visa in april for Oct-2007 start date quota.

QUESTION IS:

1. Is it legal for me to stay in the country during april-2007 to october-2007, until my new H1B approved and start new job.

2. If it is legal to stay is it possible to travel outside the country during that time.

3. Incase if i loose job even before april filing date in april, do u suggest i go for H4 on to my wifes H1B and later in april i apply for H1B, then is it possible to apply for H1B before my H4 approved.

The best way to keep your status in tact is to apply both H4 and h1 simultaneously.


So you will be H4 until your h1 is effective.
