H1B Visa application and I140,485 question

I140,485 were concreently filed for me.I140 was only filed for me and where in family members were also mentioned in part 7 .I-485 was filed for all.
Now I need to send for H1b revalidation.
In DS156,Field 36:has any one ever filed immigrant visa:
My case :Yes.
For family:My understanding is that to be absolute 'NO' as no body filed I140 for them separately(and they will be dependent on me).
Please clarify me as some different opinions were expressed elesewhere,regarding this.

---- You are correct if I-140 is filed then answer has to be YES
For family: My understanding is that to be absolute 'NO' as no body filed I140 for them separately (and they will be dependent on me).
---- You are correct dependents will write NO as no I-140 has been filed for them

** Remember every MALE age16-45 age has to fill up DS-157 also

If we say only 'NO' now and nothing added, is it not a breach of facts,which may afffect later?(False representation,knowingly they may work in the immediate future after getting EAD? for example).
Or giving additional information invites any problems?

--- No effect when they get EAD they can work, on date of filing they don’t have EAD

Regarding concurrent filing of I140/I485

Hi Ginnu,

I have a question please help me!

My wife's visa got refused under 221(g) and I am yet to get a reply from Chennai consulate. But in the meantime I am planning to apply I140/I485 concurrently along with EAD.

Questions:

1) Can I apply it separately and later on when my wife comes can I join her?

2) Since it is concurrent filling some of my friends are saying since you are applying for Adjustment of Status if you file it your wife cannot come inside US?

3) If I can apply separately how much time will I get before adding my wife processing?

I-485

HI Venkats,

I am in a similar situation also. My H-1B expires on Nov 15 2003 and the company wanted me to use the EAD after that date. SO I got married and my wife got her H-4 and immediately she came over to usa just this week. SO I added her name into I-485 process.

You can apply concurrently now and still apply for her an H-4 Visa since u still are on H-1B. After she gets her H-4 add her name into I-485 stage. COnsidering the number of years it is taking nowadays to get it approved, I think u still have two years to add her nakme into It. You can add your wife name Until you get Your Green Card or Approval Letter of I-485.

Your wife can come to USA even IF you have filed concurrently. SHe can come on H-4 if you have not used your EAD.

You can get well beyond two years for adding her name. SO relax.

----- That is incorrect info, you can apply your I-485 with I-140 and once wife reaches US then file her I-485

----- you can add your wife any time BEFORE your I-485 gets approved ( at this time I-485 approval is taking 20- 24 months minimum
