H1B (U.S.Masters Degree)

Hi
I have question on 20 000 H1B U.S Masters degree qualification.
What is the Start date for this 20,000 quota and is there any time limitation for this quota because I am planning to graduate in Dec-2005,So can i still apply for H1B after Dec-2005.

Yes,provided any left at that time. So for only less than 50% h1s are filed.

You can not file until you have received the degree (or at least when you have completed all work for the degree - maybe). The degree must be from a US University, not a foreign equivalent.

My posting is very clear to even lay person. Why attorney is giving explanation on it? Is there any reason?
I posted, he can go for 20,000 quota at that time (Dec 2005 when he graduate)


The degree must be from a US University, not a foreign equivalent. Yes should be Masters or Higher not Bachelor degree as you posted earlier. Though you are attorney, I no need to accept your wrong posting. Attorney too commit mistakes.

I should clarify, I work for attorney as a consultant means - whenever attorney has problem/not understanding the NIV/LC cases in technical issues they will consult me. I will give them advise. Some of the attorneys are 15+ yrs in their profession. That is my position.

I graduated in MS Engg TECH DEC 2000 Pitt
worked on H1B apr 2001- Nov 2004
Left for india Nov 15 2004
H1b Visa expired May 2005
Would like to file new H1
1. do i qualify for US masters H1 or only for fresh graduates.( as i read H1B cap has been reached)

2. as i have been out so long i hear if one stays out for 365 days 6 yrs h1 limit is reset. please advise when i should file for h1 as i feel i have been procastinating..

[I]"As directed by the H1B Visa reform act of 2004, USCIS treat as exempt from the cap for any fiscal year the first 20,000 h1B petitions reflecting an alien beneficiary with a US earned master's or higher degree"[/I] I t does not specify fresh or old US MS graduates. So everybody with US masters degree will qualify for this quota

You can start applying your H1 after completing 365 days stays out of US , as a new H1 application. Never ever change or extend the old H1 visas.

per your post US Bachelor's degree holders are eliglble for 20,000 exempt quota. Which is absolutely wrong information, I am using absolute term once again. If lay people give wrong info, it is understood that they are not able to understand the legal term/statement. IF a JD give this statement , all the people tend to beleive it, that bachelors degree holders are eligible to apply for 20,000 quota.
