H1B Transfer

Hi,

Appreciate your help with answering the following questions, or directing me to the relevant links:

Situation: New H1B approved under the quota. Work to start on October 1. Need to change employers at some point in the future. (Weeks to a couple of months)

Questions:
1. What is the earliest date that the current H1B can be transferred? My understanding is that the earliest that it can be done is 2 weeks. Is that correct? (We are planning to wait about two months. I hope that this will be enough time)

2. The "Transfer" process is actually a "New Application" by the new employer. Since the first H1B was counted under the cap, it is my understanding that this one should come through without any difficulty, as long as the qualifications and company health etc. are all right. Is that correct?

3. We are planning to apply for premium processing for the second H1B and hopefully this should come through within two weeks or so. Is that correct?

4. The current employer does not get notified or in any way know about the next H1B unless I tell them. Is that correct?

5. How long can I wait after my second H1B comes through, before I have to transfer to the new employer (For the purpose of giving my current employer enough notice)

transfer is not a new H1b!! Its simply a transfer of the old H1 with the remainder clock being counted from the day the original H1 was issued.

And you're planning on quitting the company which filed for your H1-b within a few weeks of joining? Not very ethical - this kind of oppurtunistic jumping gives the entire H1B community a bad name.

Please consider working for a little while for ur employer who took pains to file the H1b in the first place.

No, working for current employer for about a year now on OPT, and will work a few more months and will give due notice.

Question posed to get a feel for what the laws are.

Appreciate the clarification though.
