H1B transfer

I needed some advise on H1B transfer.I have been working for a consultant for the last 2 months but my employer is giving me a lot of problems. First he paid me my first months salary after constant pestering for 3 weeks. I got the salary for the month of April in the 3rd week of May. Now he is not giving me my pay stubs or apointment letter he keeps making some excuse or the other. I want to transfer my visa to another company, will I be able to do that without pay stubs? I have all the time sheets that I have got signed from the client which shows that I worked for them for the last 2 months and am still working. I also have all the e-mails that I have sent my employer requesting for my salary as well as pay stub and appointment letter. Do you think all this would help in getting the transfer done. Please advise.

Hi there,

I have a same problem. My employer is not giving me pay stubs or appointment letter. They are not giving me even my h1-b approval notice. Any idea on how to get my h1-b transferred to some other good company ?

Thanks.

Did you find a Job?
Is Sponser ready to file your H1 transfer?
If yes, you can tell your new company attorney the situation with old company.
Give him copies of last pay stub, remaining days - proof of time sheet, e-mails etc.

You can claim that , you are transferring this H1 because old employer is not paying salary. Once you filed your H1 and got receipt, you have to write to DOL and INS regarding non payment of your salary.
Once your write to them you will get all your salary, even if you are in bench. Read my posting giving deatils about employer not paying the employee, case verdict.
