H1b transfer without visa stamping--need urgent help

Hello,

I was on H4 visa residing in United States and got my H1 visa approved in 2009 quota. I haven’t got my H1 visa stamped yet as I did not go out of the country. I only have a H4 visa stamping on my passport. I am planning to get my H1B visa stamped later this year.

I am trying to transfer my H1B to a new employer with couple of paychecks. I am not sure if not having a H1B visa stamped on my passport going to create any issues for H1B transfer? Please help!!

---------was it filed as H4 to H1 Change of status? did you got H1 approval notice with I-94 attached(lower ridht side)?? if your employer filed H4 to H1 COS and your H1 approval notice has I-94 attached then you are NOT on H4 status.

--------if you are on H1 status with I-94 attached with H1 approval notice then you need to work with employer who filed H1. Employer must pay you and you need 2-3 latest pay stubs so that new employer can file H1 transfer for you. if you are on H1 and employer is not paying you and you are not working then you are out of status and H1 transfer may be denied.
