H1B Transfer without entering US on first H1B

Hi All ,

I had a doubt about H1 B Visa transfer , My H1B got approved in October last year and I had a successful stamping in January... now I want to switch jobs and go to US from a different company.. Would this new company have to file for a new H1B or can they do a transfer .. Also will the fact that I took a H1 from a company and didn't travel reflect bad upon me or my current company ? :confused:

Any help would be really appreciated.

----- as you are not in US and has not worked with previous employer and you may not have RECENT letter from previous employer to come to US, your new employer has to file Fresh H1 for you, after approval, get H1visa stamp and enter Or if the previous employer has job for you ask for recent job offer letter enter US work with him 2-3 months, get Paid, once you have 3-4 recent pay stubs then new employer can file for H1 transfer

------ if you enter with that Visa stamp they may ask for employer letter at POE

Hi Ginnu ,

thanks for the really fast reply. I have a recent letter dated around end of December from my current employer which says that my earlier offer letter is in good standing .

Will that help ?

---- it will help but does he has job for you? will he pay you for 2-3 months so that you get pay stubs?? you can ask him directly, FYI, BENCH or Table is not allowed by DOL.
