H1B Transfer while current H1b extension is pending.

Hi Guys,

Please help me out. Can anyone apply for a H1B transfer to another company with the pending receipt while his current H1B extension is pending in INS.

yes. you can do it as long as your current I-94 is valid for few more weeks/day and make sure you file for transfer before filing for extn.

if the transfer is filed after filing for extn then, they will issue an rfe case is already filed and pending, then u have to file transfer only based on rexceipt notice.

I already filed for extension with current employer and for some reason i am looking for another company as soon as possible. do you think i will face a problem, if the new employer file my transfer based on my current pending receipt?
