I have been working full time for company A, Canada. Recently, I worked on US project with H1B, but still paid CAN$. The H1B petition indicates company A will perform payroll transfer to US, but they have not done so.
I would like to join a new company B full time, but probably company A still has some part-time work for me. My I-129 for new company B has not been submitted and I am considering to ask the new lawyer to do a H1B transfer (check box "New Employment") or New H1B ("New Concurrent Employment").
Question:
1. If I perform H1B transfer, will there be problem if I don't have US paycheck ? I assume I don't need US paycheck proof if I do a concurrent H1B.
2. If I perform H1B transfer, and then work full time for company B, can company A still files an amendment H1B to convert fulltime to parttime ? (This save them $1000)
3. If I perform New Concurrent H1B, will INS question because both H1B for company A & B are filed as full time ?
