H1B transfer (very urgent)

Hi Guys,

I have a approved H1B visa, My H1 visa started on 1st October but I never worked for that company. I joined another company on 1st week of Aug. I was working on OPT. My company has filed a H1B transfer paper after 15th of Oct. I got a query from INS that they need a paystub from 1st to 15 Oct from my previous company who filed my H1 visa. My previous company is not willing to give Paystub for that period. Could you please suggest me what can I do?

Is my OPT is still valid? I want to go to India for a marriage in end of Jan, 2005. Please suggest me what can I do?

If you did not work for the sposoring company they are not obligated to give you paystubs.

If I were you I would go back to the sponsoring company and work for them atleast 3 mos to get some paystubs before I apply for the transfer.

Talk to a lawyer. I think your OPT is toast as you applied for a H1-B transfer.
 
H1B transfer without paystubs

Hi,

I am on H1B and short term visit to onsite, i am asked to go back to india and i am planning to trsnsfer my H1B, but i dont have paystabs, i am getting paystabs in india and getting perdiems here without any paystubs here, i have document which i filed my income tax for last 2 months, i have SSN also, and my bank statement says that i have money comming from my company..., can i use any of these documtnts optional to paystubs..please suggest...i wioud be very greatfull to you, i am also looking out for a job here, i have 4.5 years experience in mainframe technology.
