CompanyA sponsored my H1B visa (for $48000 PA) and I started working for them from Apr'03. In the contract they included some provisions as given below:

Employer will provide family accommodation and car (including fuel) upto the end of year 2003; also they will hold back $22000 from the first year and will pay that amount in three 6 monthly installments, once I complete 3 years (which was Apr'06) with them. First payment was due in Dec'06.

I left this company in Jun'06; my questions are:
1) If I can receive payments (3 payments Dec'06,Jun'07, Dec'07), even if I am not employed with them
2) As of my yr 2003 return and W2 shows $10000 as total income instead of $32000. If I am not able to accept the 3 payments, as I am not employed there now, would this return be a problem for getting the greencard?
3) Even if I accept the payments, would yr 2003 return be a problem for getting the greencard?

Appreciate your reply.

regards,

First get the money. Tax return will not affect your GC, having the copy of the contract agreement from your employer.
