H1b Transfer RFE, No PayStubs

Hello all,
Company A Sponsered me on H1b, when i came here they said that they don't have projects now. So wait until we get projects and then we will pay you.
I waited for 3 months and they didn't pay me anything neither they deploy me on any project.
After 3 months i joined Company B and doing job there.
Company B applied for my H1b transfer but last week they recieved an RFE that states to submit the pay stubs of previous company.

Infact i don't have any pay stubs and Company A really screw me up.
Anyone can tell me what should i do ???
Also what could be the reply by Company B, my current company (I have paystubs of new company, would they work ? )...

I will really appreciate.

Pay stub

I think the best bet will be to hand over present employers pay stub, you have no other options. I would also suggest you to speak to good lawyer they may suggest you some tricks how to handle this situation.

If the USCIS determines that you were out of status (Not being paid) at the time of trasfer then they will deny your extension of stay and do not issue you an I-94. If they do that then you have to travel to your home country to get your visa.

So, better talk to a good immigration attorney and resolve the issue before it is too late.

i think Company A is in violation as basically they did not honor your petition. on your part, since you are already in the US you have no choice but to look for a new petitioner. You are doing the remedy in good faith and the USCIS should understand that. suggest that when you submit the paystub from your new employer, attach a narration of what happened with your Company A petition and the USCIS might summon that company for their violation.
