I worked for company A on H1B. I resigned and joined company B.
The H1B transfer is still pending. I have the receipt. Now I am
planning to go back to my previous employer company A.
Assuming Company A has not yet cancelled my H1B, I have the following questions.
1. If I join them based on the original H1B without filing for a transfer, are they liable to backpay for the last couple of months
when I was with company B ? What are the consequences if me and company A agree not to backpay ?
2. Can I file for a transfer of H1b from company B to company A
even though the original h1b has not yet been revoked?
3. Can I file for a transfer of H1b from company B to company A
based only on the receipt ? What happens if company B
cancels my pending H1B transfer before the transfer to company A
is approved?
4. What would be the correct approach in the above scenario.
