H1b Transfer Query Urgent Please reply

I have got my H1b stamped and working for the company A in US.

But the company A is not giving me pay slips...on the other hand company is paying for my car , phone , internet , home and other expense and in addtion to this i am getting around 1500 dollar per month (per diems)....and indian salary..

I wanted to shift to another company B...and the company B has asked me pay slips for H1b transfer ...i told them that i don;t have any slips as i am not getting salary in US...all i am getting is Per diems .....

i told them i can give u the following documents:
a) US Bank transaction for my per diems.
b) a docuemnt stating that Company A will be paying taxes on my behalf in US. and also the amount of taxes and other stuffs i will be getting during my stay in US.

..one thing for sure is that i can't get my pay slips from company A...

I really need to know if it is possible to get a H1b transfer if i have the above 2 docuemnts...
is there any risk involved.

please reaply back asap....it really urgent...
 
How are you getting $1500, by check or cash.?

Company is depoisting it in US Bank Account

Company is depoisting the money in US Bank Account directly...

I am not getting cheque or cash...

Here too many wrong doings. By your employer

Your company is cheating IRS (Payroll /employer tax) , State Tax and mis using H1.

You are here with H1 but no pay stub. And not paying your tax.

I think you must quit as quickly as you can.

This can be done only in co-operation with your new company attorney.

While transfereing H1 you can put a separate letter stating all the facts and copy to IRS/ why you do not have pay stub. Sooner or later you will end up with serious problem both with IRS and INS.


Worst come worst you will get a new H1 (no quota), you can go back to your home county and come back with new visa stamp. If you complain to INS & IRS and have proof, you may be releived from this crime.

Company will pay taxes

Hi ,

I have a document stating that my annual income and also the tax amount the company will be paying for me.

I have a document stating that company will be paying tax on my behalf.


so it is not the case that the company is not paying tax..they r paying tax it is just that i am not getting pay stubs...

Please reply back..
 
What kind of document do you have that you and your company is paying Federal, Social Security , State tax, SDI etc.

The US taxes paid by Company A will be calculated in the US payroll system using the effective Federal, State, Local and Social tax rates. I can get Cheque for my per deims claims

Hi ,

I can get check for all the per deims i claim...initally i told that i get around 1500 dollar perdiems per month ...as of now Compay A is directly despisting money in US Bank Account..but i can get cheque also..which i can depoist..

Please let me know if it is possible to get the transfer done by showing the cheque...and will cheque be of any use
