My situation:-
1) Currently on H1B from company A
2) Application pending for H1B transfer to company B
3) Got a better offer from company C and want to take job at company C
My lawyer says that I will be on 2 different H1Bs (one from company A and another from either company B or C) if company A is not withdrawing my H1B petition. I am worried about this statement as in the transfer application the lawyer checked the option for "change of employer".
I would appreciate if someone advise me whether this is true or false. If this is true can I keep my work at company A on a part-time basis till the expiry of my H1 from company A?
The lawyer also says that, I can take salary from company B (I am working there for two weeks) on W-2 basis without any problem from USCIS, even if company B want to withdraw my H1B petition eventually.
I am so confused....please help.
